The Colorado Supreme Court Affirms that Elephants are not Classified as People

A Washington D.C.-based animal rights organization, the Nonhuman Rights Project, had their petition to release five captive elephants in Colorado Springs rejected by the Colorado Supreme Court. The group invoked the legal tool of “habeas corpus” in an attempt to grant the elephants human rights, arguing for their transfer to an accredited animal sanctuary. However, the court ruled that Colorado’s habeas law only applies to “persons,” not animals. This decision marks a setback for the organization, which has unsuccessfully filed similar lawsuits in other states on behalf of confined animals. Despite their love for elephants, the court’s decision highlights the limitations of extending human rights to animals in the legal system. The Cheyenne Mountain Zoo, where the elephants are currently housed, will not be required to release the animals based on this ruling. The Nonhuman Rights Project’s efforts to advocate for animal rights continue to face legal challenges, as the debate over the treatment and rights of animals in captivity remains a contentious issue.
